These Terms of Service ("Terms") govern your use of the DayRoam mobile application ("the App") and the website at dayroam.overpass.co.uk ("the Website"), provided by Overpass Apps Ltd ("we", "us", "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. The Service

DayRoam is a travel companion application that provides practical information for travellers, including:

• Currency conversion between your home currency and destination currency
• Phrasebook with common expressions in the destination language
• Culture guide including tipping customs, etiquette, and emergency numbers
• Travel toolkit with city information and local tips
• Budget tracker with dual currency display

2. Important Disclaimers

Currency Information

Currency exchange rates displayed in the App are indicative only. They are provided for general reference and may not reflect the exact rate you would receive from a bank, bureau de change, or payment provider. We do not guarantee the accuracy, completeness, or timeliness of exchange rate data. You should not rely solely on the App for financial decisions. The App does not constitute financial advice.

Phrasebook and Translations

Translations and phrases are provided for general guidance only. They are intended to help with basic communication and may not capture nuances, regional dialects, or contextual meaning. We do not guarantee the accuracy of any translation. For critical communication (medical, legal, or emergency situations), you should seek assistance from a qualified interpreter.

Culture and Travel Information

Cultural information, tipping customs, etiquette guidance, and travel tips are provided in good faith based on commonly available knowledge. Cultural norms vary by region and change over time. We do not guarantee that all information is current or universally applicable.

Emergency Numbers

Emergency contact numbers are provided as a convenience. In an emergency, always verify the correct local emergency number from official sources. We accept no liability for any consequences arising from reliance on emergency numbers displayed in the App.

3. Accounts

To use certain features of the App, you may need to create an account. You are responsible for:

• Providing accurate information when creating your account
• Maintaining the security of your login credentials
• All activity that occurs under your account

You must notify us immediately at [email protected] if you become aware of any unauthorised use of your account.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorised access to our systems or other users' accounts
• Reverse-engineer, decompile, or disassemble the App
• Use automated tools to scrape or extract data from the App
• Redistribute, sell, or sub-license any part of the App

5. Intellectual Property

The App, its content, design, and underlying code are the intellectual property of Overpass Apps Ltd. All rights are reserved. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.

6. User Data

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

Budget entries, preferences, and other content you create within the App remain your data. You may request export or deletion of your data at any time by contacting us.

7. Availability and Updates

We aim to keep the App available at all times but do not guarantee uninterrupted access. We may:

• Update, modify, or discontinue features at any time
• Perform maintenance that temporarily affects availability
• Release updates that require you to accept new terms

8. Limitation of Liability

To the fullest extent permitted by law:

• The App is provided "as is" without warranties of any kind, whether express or implied
• We do not warrant that the App will be error-free, secure, or uninterrupted
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability to you for any claim arising from use of the App shall not exceed the amount you paid for the App (if any) in the 12 months preceding the claim

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

9. Third-Party Services

The App may rely on third-party services (such as exchange rate providers) that are outside our control. We are not responsible for the availability, accuracy, or performance of third-party services.

10. Termination

You may stop using the App at any time by uninstalling it and deleting your account. We may suspend or terminate your access if you breach these Terms, with or without prior notice.

Upon termination, your right to use the App ceases immediately. Sections relating to disclaimers, intellectual property, limitation of liability, and governing law survive termination.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
